The Four Elements of a Tort

- The existence of a duty. In legal terms, a duty is an obligation to take reasonable steps to prevent injury from befalling another. For example, a property owner has an obligation to keep his or her property in safe condition.
- The breach of that duty. The person who injured you failed to live up to his or her duty. This can mean that he or she failed to provide a safe environment, or failed to act in a way that would not injure you.
- The occurrence of an injury. You must have sustained a real injury.
- The breach of duty caused the injury. The breach of duty must have more or less directly led to your injury.
