Receiving a Settlement
After meeting with your attorney and filing a claim, you will notify the defendant of the suit against them. Then, each party will begin collecting evidence which supports their case. Evidence may consist of expert witnesses, medical bills, and eyewitnesses. After each party has gathered their evidence, negotiations will begin.
One party will submit a suggestion for the amount of compensation the victim deserves. If this satisfies both parties, it is accepted, and the determined amount is called the “settlement.” If this does not satisfy both parties, they can submit a revised settlement offer. This process continues until both parties are satisfied with the settlement amount. If an agreement cannot be reached, it is only then that the case will go to court and be presented before a judge.
