A 74-year old Austin resident was hospitalized after his motorcycle was struck by a police vehicle at the intersection of Lamplight Village and Magazine Street. Eyewitnesses say that the officer, a 10-year veteran of the APD, was not paying attention to the road and accidentally glided through the intersection despite the fact that he thought the vehicle was idling. It is believed that the officer was paying attention to the vehicle's onboard communications systems and did not notice that the vehicle was in motion. Although the force of impact was only around 10 miles per hour, the driver of the motorcycle sustained injuries that were serious enough to require hospitalization for several days.
If you have been hurt due to the negligent actions of another person, you may be eligible to take legal action to recover damages including pain, suffering, and medical expenses. The railroad crossing on 51st street near Airport Boulevard in central Austin will be monitored this week and next as Capital Metro begins its light rail service.
The crossing is viewed as one of the locations with the greatest accident risk because it is positioned near the Airport Boulevard intersection and vehicles often stop illegally on the tracks. The light rail trains run silently and will not be giving a warning horn blast before they enter the crossing.
Austin police plan to monitor this risky crossing over the next couple of weeks and will be issuing tickets to drivers who fail to keep the crossing clear. According to an Austin Police Department representative, the fines will average about $200 per ticket but can be as high as $500.
