House passes ‘Loser pays’ bill

Posted on May 11th, 2011 No Comments

Last weekend, the Texas House of Representatives held an emergency legislative session in which they voted on a bill referred to as the “loser pays bill.”

The bill proposes allowing winning parties in lawsuits to be awarded compensation for litigation fees.  In addition, the bill, House Bill 247, proposes granting compensation for litigation fees to defendants who have settlements rejected by the other party.  Also, in cases where the plaintiff rejects a defendant’s offered settlement and wins less than 80 percent of the settlement, the plaintiff would have to pay for the defendant’s litigation fees.

47 state representatives did not attend the session for the vote.  However, the bill still managed to pass with an 89 to 12 vote.

Now, HB 274 will be sent to the Senate for another vote.

A hit-and-run pedestrian accident occurred Friday around midnight in Longview, Texas.  The car accident occurred on the 1300 block of East Marshall Avenue which is a stretch of the highway with several bars and nightclubs.

Witnesses to the accident say 45-year old William J. Jones walked out of a parking lot to cross the street when he was hit by a white Geo Tracker.  Jones rolled over the hood of the car and into the median and the Geo Tracker fled the scene of the accident.  Witnesses estimated that the vehicle was traveling at around 45 to 50 miles per hour when it hit Jones.

Longview police later found a car that exhibited evidence of a hit-an-run and arrested 22-year old Anna Catherine Shore.  Shore is being held in Gregg County Jail with charges of driving with a suspended license and failing to stop at an accident involving personal injury.  Authorities are awaiting the results from a blood sample taken from Shore to find out whether or not she was driving while intoxicated.

The risks of owning a swimming pool

Posted on May 25th, 2010 No Comments

During the hot summer months, many individuals and families bear the heat by going to a swimming pool. In some cases, individuals or families own a swimming pool in their backyard.

While owning a swimming pool has many benefits, there are also many risks. One of the most dangerous risks is that individuals will drown in the pool. For that reason, swimming pool owners may want to ensure that anyone who swims in their pool knows how to swim.

Another risk is that small children will fall into the pool and drwon. For this reason, owners may want to consider adding a fence around their pool.

Rail Crossing Seen As Accident Risk

Posted on March 18th, 2010 No Comments

The railroad crossing on 51st street near Airport Boulevard in central Austin will be monitored this week and next as Capital Metro begins its light rail service.

The crossing is viewed as one of the locations with the greatest accident risk because it is positioned near the Airport Boulevard intersection and vehicles often stop illegally on the tracks. The light rail trains run silently and will not be giving a warning horn blast before they enter the crossing.

Austin police plan to monitor this risky crossing over the next couple of weeks and will be issuing tickets to drivers who fail to keep the crossing clear. According to an Austin Police Department representative, the fines will average about $200 per ticket but can be as high as $500.

If you or someone you know has been injured in a car accident at a rail crossing, contact the Austin personal injury attorneys of Vic Feazell, P.C. today at 512-372-8100.

The potential dangers of operating a forklift

Posted on March 12th, 2010 No Comments

Like operating most heavy machinery, operating a forklift requires both training and experience. Individuals who are licensed to operate forklifts often undergo many hours of training as required by law and their companies.

Even with this training, individuals that operate forklifts still can mishandle the heavy equipment. In some cases, this mishandling can lead to forklift accidents. These accidents present a high chance of leading to serious injuries.

If you or anyone you know has been injured in a forklift accident, contact the Austin forklift accident attorneys of Vic Feazell, P.C., at 877-948-4842.
