Recall issued for listeria-contaminated cantaloupes

Two weeks ago, the U.S. Food & Drug Administration and Jensen Farms in Colorado announced a recall of cantaloupes contaminated with listeria bacteria.  The cantaloupes were distributed to stores in 24 states, including Texas.

Currently, officials with the U.S. Centers for Disease Control and Prevention believe 16 deaths could be linked to consumption of the contaminated cantaloupes.  Two of the fatalities were in Texas.

The toxic food product was sold to stores between July 29 and September 10.  The cantaloupes should be removed from store shelves, but can be identified by a “Sweet Rocky Fords,” “Colorado Grown,” “Distributed by Frontera Produce,” or “Jensenfarms.com” sticker.

2-year old injured in North Texas dog attack

A 2-year old girl was recently taken to Dallas Children’s Hospital for treatment of injuries she suffered in a dog attack.  The attack occurred in Upshur County and the toddler was taken to a local hospital before being transferred to Dallas Children’s.

The toddler’s family told police that the child was visiting a house near Pritchett and Gilmer when a dog at the home attacked her.  The dog, which appeared to be sleeping, was startled and jumped on the toddler as she walked by.  The girl was bit on her forehead and lip.

The girl had to have plastic surgery to repair the injuries to her lip.  In addition, doctors believe the cut on her forehead may need stitches.

Dodge issues recall of Ram pickup trucks

Yesterday, Chrysler Group LLC and Dodge announced the recall of around 280,000 Ram pickup trucks.  The recalled vehicles were manufactured and sold between 2003 and 2011.

According to the car manufacturer, the left, front steering assemblies on 1500, 2500, and 3500 model Ram pickup trucks are defective.  The tie rod ball stud in the assemblies were found to have a tendency to break easily when performing “high-stress maneuvers.”

If this part of the vehicle breaks, the left front wheel will lose some directional stability and increase the chance of an accident.

Chrysler has received reports of multiple accidents caused by the defect and at least 1 injury.

W hotel closes after third falling glass panel accident

Officials with the W Hotel in Austin recently announced that the hotel will be closed until all glass panels on balconies at the hotel are replaced.  The announcement comes after a third incident at the hotel involving falling glass panels from balconies.

The third incident occurred on the same day a lawsuit was filed against the hotel over the first accident, which occurred on June 10.  The first time glass panels fell at the hotel they fell onto the hotel’s pool deck and injured several people at the pool.

Earlier this week, a second incident occurred in which panels fell from balconies located over 3rd street and onto cars below.  The next day, three more glass panel fell from the hotel’s south side.

House passes ‘Loser pays’ bill

Last weekend, the Texas House of Representatives held an emergency legislative session in which they voted on a bill referred to as the “loser pays bill.”

The bill proposes allowing winning parties in lawsuits to be awarded compensation for litigation fees.  In addition, the bill, House Bill 247, proposes granting compensation for litigation fees to defendants who have settlements rejected by the other party.  Also, in cases where the plaintiff rejects a defendant’s offered settlement and wins less than 80 percent of the settlement, the plaintiff would have to pay for the defendant’s litigation fees.

47 state representatives did not attend the session for the vote.  However, the bill still managed to pass with an 89 to 12 vote.

Now, HB 274 will be sent to the Senate for another vote.

Mother files wrongful death suit against Four Loko

Recently, a mother filed a wrongful death lawsuit against the maker of the caffeinated, alcoholic beverage, Four Loko.  The drink’s maker, Phusion Projects, is accused of negligence in creating a product which increases the risk of “alcohol-related harm.”

According to the lawsuit, the mother’s 15-year old son died after drinking two cans of Four Loko.  The teen obtained the alcoholic beverages at a convenience store before attending a concert in September 2010.  At the concert, officials called his parents to pick him up because he was acting erratically.

The boy’s mother picked him up to drive him home from the concert.  On the drive home, the teen jumped out of the vehicle and ran away.  He was struck by another vehicle on the highway and killed.

18-wheeler accident in Seguin leaves two injured

Yesterday, a truck accident in Seguin left two people injured.  The accident occurred at around 12:30 P.M. at the intersection of West Court Street and Highway 46 when a pickup truck and 18-wheeler semi-truck collided.  Investigators are looking into the accident to determine if the driver of the pick-up truck or the semi-truck should be held responsible.

After colliding, the pickup truck slid into a light pole and the truck’s bed and cab separated.  Both drivers, a 71-year old New Braunfels man and a 74-year old Seguin man, were taken to hospitals for treatment of unspecified injuries.  The semi-truck driver was said to have suffered non-life-threatening injuries, but the conditions of either driver were not reported.

Porch collapse kills Michigan mail carrier

Earlier this month, a mail carrier was killed in a tragic porch collapse in Dundee, Michigan.  46-year old Nancy Schafer had worked as a mail carrier for several years before the accident.

Schafer was on-duty dropping mail off at a home and talking on her cell phone with a fellow mail carrier when the home’s porch suddenly collapsed.  In the collapse, Schafer fell around 8 to 10 feet.  Also, because the porch had been constructed over a former entrance to the home’s basement, the concrete slab underneath also fell.

The mail carrier was able to tell her co-worker she needed help after falling.  However, the approximately 500 pounds of weight from the concrete slab suffocated the victim and she was pronounced dead about an hour after paramedics and emergency crews were able to extricate her from underneath the rubble.

Our utmost sympathies go out to Schafer’s family and friends.

State legislators consider texting while driving bans

Last week, several bills proposing a ban on texting while driving were considered by the House Transportation Committee.  Both Democrats and Republicans in the House of Representatives are putting their support behind passing one of these bills.

Former House Speaker Tom Craddick of Midland said that he believed having a statewide law regarding texting and driving would be much more effective than leaving the issue in the hands of Texas cities.  Under the bill Craddick created, individuals caught texting while driving would be fined $200 for their first offense.

Representative Jose Menendez created a bill that would completely prohibit using a cell phone while driving unless the driver uses a hands-free device.  Supporters of this bill say it would be easier to enforce because law enforcement officers would not have to distinguish between drivers simply holding a cell phone and drivers texting.  In addition, the bill specifies that drivers would be allowed to use cell phones while driving to call 9-1-1.

Hospitals see rise in dog bite, animal attack victims

Bloomberg Businessweek reports that, over the past couple decades, hospitals have seen significant increases in the number of patients they treat for dog bites and injuries from animal attacks.  In addition, statistics show that about 4.5 million people in the United States are the victim of a dog bite or animal attack every year.

In 1993, hospitals in the United States recorded treating about 5,100 people for dog bites.  Only 16 years later, in 2008, the number doubled, with 9,500 people going to the hospital for treatment of a dog bite.

“We found that most children had been bitten by dogs that had no history of biting.  Most important here, familiar children were bitten most often in the contexts of nice interactions, such as kissing and hugging with their own dogs or dogs that they knew,” said veterinary behaviorist Dr. Ilana Reisner.
