			<content:encoded><![CDATA[<p>This weekend, a South Austin apartment complex caught fire, injuring several and leaving 44 displaced from their homes.  Early Sunday morning around 5:30 AM, four apartments in the Bainbridge Villas on Southridge Drive became engulfed in flames, leaving approximately $840,000 worth of structural damage.  Eight other apartments suffered less serious damage from the fire.</p>
<p>Four people had to be taken to hospitals for their injuries, at least two of which suffered from broken bones after jumping from their apartment&#8217;s windows.  One resident was transported to the Brooke Army Medical Center in San Antonio for severe burning on her feet.</p>
<p>Investigators have not yet determined what caused the <a href="http://www.withvic.com/practice-areas/premises-liability/fire-victim/">fire</a>.</p>
<p>Our thoughts and prayers go out to the those who lost their homes and belongings in the fire.</p>

			<content:encoded><![CDATA[<p>On August 13th, the Food and Drug Administration announced the recall of 228 million eggs from three Wright County egg farms in Iowa.  Then, last Friday the recall expanded to include all five Wright County egg farms and 360 million eggs.  Now, the recall has expanded to include over 550 million eggs from all Wright County farms and Hillandale Farms after investigators realized the two farms use the same chicken and feed.</p>
<p>The initial recalls came after several cases of salmonella food poisoning in connection with the eggs and epidemiologic evidence of salmonella bacteria at the farms.</p>
<p>The recalled eggs were distributed from Wright County and Hillandale farms on May 16th.  There have been 1,200 reported cases of salmonella food poisoning across the country.  Cases of food poisoning have been clustered in Arizona, California, Colorado, Illinois, Nevada, North Carolina, Texas, and Wisconsin.</p>

			<content:encoded><![CDATA[<p>Last month, $750,000 was awarded to the family of an 18-year old man who was <a href="http://www.withvic.com/practice-areas/wrongful-death/">wrongfully killed</a> by an Austin Police Department officer.</p>
<p>Nathaniel Sanders&#8217; family filed suit against the city after their son was shot and killed at the Walnut Creek Apartments in East Austin in 2009.  Sanders and two friends were sleeping in a car when they were approached by Austin police officer Lenny Quintana.  Sanders and his friends awoke to Quintana trying to arrest them.  Quintana then thought he saw Sanders grabbing for a gun on his waistband and reacted by shooting him.</p>
<p>Keypoint Government Solutions investigated the tragic incident and stated that Quintana had used excessive and unnecessary deadly force.  Quintana was not billed for his role in the shooting, but was suspended for not having his dashcam recorder on at the time.  He was later released from his position for a DUI arrest.</p>

			<content:encoded><![CDATA[<p>On August 6th, the USDA and the California-based Valley Meat Company announced a recall of over one million pounds of ground beef.  The two decided on the recall after reports of E. coli containing products.</p>
<p>The affected products are mostly Valley Meat Company&#8217;s frozen ground beef produced between October 2009 and January 2010.  Seven people have been affected by the products, all with the same strand of E. coli 0157:H7.  The USDA warns consumers that the product could still be in their homes or grocery stores because it is frozen.</p>
<p>E. coli can be fatal to children, the elderly, and people with other health problems.  The USDA is investigating what caused the E.coli to contaminate Valley Meat Company&#8217;s products.</p>

			<content:encoded><![CDATA[<p>A Midland family is suing a driver and the company he works for after he was involved in a fatal car accident that killed 47-year olds Marina Lisa Robles and Joe Luis Ramon on June 21st.</p>
<p>The accident occurred when Justin Paul Pruett was driving an A-1 Fire and Safety Equiment Company truck on Business 20 near Center Avenue and collided head-on with Robles&#8217; vehicle.</p>
<p>Robles&#8217; family has filed a <a href="http://www.withvic.com/practice-areas/wrongful-death/">wrongful death</a> lawsuit against Pruett arguing that he has &#8220;a history of alcohol and/or drug offenses&#8221;.  However, the defense has stated that Pruett only has one Class B misdemeanor for possession of marijuana on his record from 1998.  Furthermore, the family included A-1 Fire and Safety Equipment in the suit for hiring and entrusting Pruett to operate a company vehicle.</p>
<p>Our utmost sympathies go out to Robles&#8217; and Ramon&#8217;s family and friends.</p>

			<content:encoded><![CDATA[<p>The Medical Board of California is suing the fertility doctor who treated infamous &#8220;Octomom&#8221; Nadya Suleman.  Suleman gained national attention after receiving fertility treatments which eventually made her pregnant and give birth to octuplets when she already had six children and no job.</p>
<p>Now, the Board is accusing Dr. Michael Kamrava of medical malpractice in two other instances.  In the first instance, the Board is accusing Dr. Kamrava of implanting seven embryos in a 48-year old woman, putting her at high risk for serious birth complications.  The woman became pregnant with quadruplets, lost one fetus, and gave birth to three babies via c-section delivery.  One of the babies suffers from serious developmental delays.  Furthermore, the Board alleges that Kamrava did not suggest the woman have a mental health evaluation or counseling before his treatments, which they believe to be an extreme departure from standard professional medical practice.</p>
<p>In the second instance, the Board accuses Kamrava of ignoring suspicions of the presence of ovarian cysts after looking over a patient&#8217;s cytology results.  When the woman did not become pregnant, she sought out a second opinion only to find that she had stage three ovarian cancer.</p>

<p>The products being taken off store shelves are Kellogg&#39;s Froot Loops, Honey Smacks, Corn Pops, and Apple Jacks. &nbsp;Kellogg&#39;s became concerned after reports that the products had an uncharacteristic smell and flavor coming from the liner of the packaging. &nbsp;While Kellogg&#39;s believes any risk associated with these products is very small, they advise people who have purchased a product before June 29th to refrain from eating it.</p>
<p>Foster&#39;s Food Fair IGA stated, &quot;Until further correspondence from the manufacturer on this affected product, moving forward, it will not be available&quot;.</p>

			<content:encoded><![CDATA[<p>A 74-year old Austin resident was hospitalized after his motorcycle was struck by a police vehicle at the intersection of Lamplight Village and Magazine Street. Eyewitnesses say that the officer, a 10-year veteran of the APD, was not paying attention to the road and accidentally glided through the intersection despite the fact that he thought the vehicle was idling. It is believed that the officer was paying attention to the vehicle&#39;s onboard communications systems and did not notice that the vehicle was in motion. &nbsp;Although the force of impact was only around 10 miles per hour, the driver of the motorcycle sustained injuries that were serious enough to require hospitalization for several days.&nbsp;</p>

An initial investigation showed that a collision between a Honda and an orange Harley Davidson <a href="http://www.withvic.com/practiceareas/austin-motorcycle-accident-lawyer.aspx">motorcycle</a>, resulted in the death of the motorcyclist Tuesday.&nbsp; The accident occurred when the silver Honda, which was traveling southbound on Emerald Forest Drive slowed down to turn left onto a side street.&nbsp; The motorcycle was also traveling southbound on the same road and did not slow down in time to brake.&nbsp; It collided into the back of the car and the motorcyclist was ejected from his vehicle.&nbsp;

Emergency Medical Services immediately transported the biker to the University Medical Center with serious injuries.&nbsp; He was pronounced dead on Wednesday.&nbsp; The motorcyclist was found to have alcohol in his system. &nbsp; The driver of the Honda went uninjured and no charges are set to be made in this incident.&nbsp; The case is still under investigation.

A Central Texas police officer was injured when a speeding vehicle he was chasing caused him to strike a parked pick-up truck at approximately 9 a.m. on Wednesday.&nbsp; The officer was taken to Hillcrest Baptist Medical Center in Waco via ambulance.&nbsp; Neither the officer&#39;s name nor the degree of his injuries have been released to the public yet.&nbsp; Authorities say that the injured officer was in pursuit of the speeding car when another vehicle pulled out in front of him, causing him to swerve to avoid a collision.&nbsp; Instead, the patrol car struck the parked truck.

<p>
The accident occurred at the intersection of Texas Avenue and Pearl Street in Mart, Texas.&nbsp; The chase occurred along State Highway 164 when the officer was trying to stop a vehicle that was traveling 17 miles per hour over the speed limit.&nbsp; The speeder got away and no traffic citations have been issued.&nbsp; Texas Department of Public Safety officials are investigating the incident.
